AccuRadio and SoundExchange have reached a temporary payment agreement amid their ongoing licensing dispute, with AccuRadio agreeing to pay $210,000 monthly while litigation continues.

Key Agreement Terms:

  • AccuRadio will pay SoundExchange $210,000 on the first of each month
  • Payments will continue until final judgment is reached
  • The amount can be adjusted if both parties agree in writing
  • Adjustments will be based on AccuRadio's average monthly performance numbers and current regulatory rates
  • AccuRadio will receive full credit for these payments against any final liability

SoundExchange has withdrawn its preliminary injunction motion but maintains the right to:

  • Refile the injunction if payments are missed
  • Seek expedited briefing
  • Pursue other appropriate relief

This agreement comes after SoundExchange filed a lawsuit in July alleging unpaid royalty payments from AccuRadio. The streaming service initially described the lawsuit as "a complete surprise."

This case runs parallel to SoundExchange's separate ongoing royalty dispute with SiriusXM, which includes counterclaims from the satellite radio provider.
